Welcome to GiftSasa. These Terms of Service ("Terms") apply to everyone who uses giftsasa.com, whether you are buying gifts ("Customer") or selling through our platform ("Shop" or "Vendor"). GiftSasa is operated by [Your registered business name], Kenya ("GiftSasa", "we", "us"). By creating an account or placing an order, you agree to these Terms.

1. What GiftSasa is

GiftSasa is an online marketplace. Independent gift shops list their products and custom gift packs, and customers buy from them. Each Shop is a separate business and is responsible for the products it sells, their quality, preparation and delivery. GiftSasa provides the platform, the ordering and payment system, and customer support.

2. Your account

  • You must give accurate information, including a working phone number and email address.
  • You are responsible for keeping your password safe and for everything done through your account.
  • You must be at least 18 years old to create an account and place orders.
  • We may suspend or close accounts that break these Terms, give false information, or are used for fraud.

3. Orders and customization

  • When you place an order, a separate order is created for each Shop in your cart.
  • Customization requests (names, messages, colours, contents) must be agreed with the Shop through the order chat. Please give clear, complete instructions.
  • A Shop may accept or reject an order. If an order is rejected, you will receive a full refund of any amount paid.
  • Custom gift packs are made to your request at the price quoted by the Shop. Once you accept a quote and the Shop starts preparing it, the order cannot be changed without the Shop's agreement.
  • Product photos are examples. Natural items such as flowers, cakes and hampers may vary slightly in colour, size or contents; the Shop will substitute items of similar or higher value where needed.

4. Prices and payment

  • All prices are in Kenya Shillings (KES) and include the item price, any packaging you choose, and the delivery fee set by the Shop for your county.
  • You can pay by M-Pesa at checkout or, where offered, pay on delivery.
  • An M-Pesa order is only confirmed once payment is received. Unpaid orders are cancelled automatically after a short period.

5. Delivery

  • Each Shop chooses the counties it delivers to and sets its own delivery fees and times. These are shown before you pay.
  • You must give a correct delivery address and a reachable recipient phone number. If delivery fails because of wrong details or an unreachable recipient, a second delivery may be charged.
  • Delivery dates are estimates. Shops make every effort to deliver on the date you choose, especially for time-sensitive occasions.

6. Cancellations and refunds

You can cancel an order free of charge until the Shop accepts it. After that, cancellations and refunds follow our Refund Policy.

7. Rules for Shops

  • Shops must be approved by GiftSasa before selling.
  • Shops must describe products honestly, keep stock and prices accurate, respond to customers promptly, and deliver as agreed.
  • Shops must hold any licences required for what they sell. Alcohol may only be sold by licensed sellers and delivered to recipients aged 18 or over.
  • GiftSasa charges Shops a commission on each completed order, as agreed when the Shop joins. Payouts are made after delivery.
  • Shops must not ask customers to pay outside GiftSasa for orders started on the platform.

8. Using the chat

The chat is for arranging your order. Be respectful. Do not send offensive, fraudulent or illegal content. We may review conversations to resolve disputes, prevent fraud and improve our service.

9. Prohibited items

Shops may not list illegal goods, counterfeit or stolen goods, weapons, drugs, or anything that breaks Kenyan law. We may remove any listing at our discretion.

10. Liability

Shops are responsible for the products they sell. GiftSasa will help resolve problems between Customers and Shops, but to the extent allowed by law, GiftSasa is not liable for indirect losses, or for losses caused by a Shop, a delivery service, or events beyond our reasonable control. Nothing in these Terms limits your rights under Kenya's Consumer Protection Act.

11. Privacy

We handle your personal information as described in our Privacy Policy.

12. Changes to these Terms

We may update these Terms from time to time. The date at the top shows the latest version. Continuing to use GiftSasa after changes means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Kenya. Any dispute will first be handled through our support team, and if unresolved, by the courts of Kenya.
